Refund Policy

This Refund and Dispute Policy explains when refunds may be available and how disputes are handled on SwayGifts.

By using SwayGifts, you agree to the terms of this Policy.

1. General Principles

  • SwayGifts is a digital gifting experience platform centred on celebration messages.
  • Celebration messages are delivered independently of payment and remain visible regardless of payment outcome.
  • When a gift amount is included, payment is processed by a third-party payment service provider and settled directly into the recipient’s account with the payment provider.
  • SwayGifts does not hold, custody, or control user funds.
  • Refunds are not issued directly by SwayGifts. All refunds are processed through the applicable payment service provider.

2. Message-Only Gifts

If no gift amount is included:

  • no payment occurs,
  • no refund is applicable.

Messages sent without a gift amount are not refundable.

3. Gifts With a Gift Amount

When a gift amount is included with a celebration message:

  • payment is processed at checkout,
  • funds are settled directly into the recipient’s account with the payment provider,
  • any applicable service fee is disclosed before payment.

Because the celebration message is delivered immediately, gifts are generally considered completed once payment succeeds.

4. Situations Where Refunds May Apply

Refunds may be considered in limited circumstances, including:

  • duplicate charges caused by a technical error,
  • payment processed in error (for example, an incorrect amount),
  • unauthorised transactions, subject to investigation,
  • transactions required to be refunded under applicable law.

Refund eligibility depends on the specific circumstances of each case, applicable laws, and payment service provider rules.

5. Situations Where Refunds Do Not Apply

Refunds are generally not available when:

  • the celebration message has been delivered as intended,
  • the sender changes their mind after sending a gift,
  • the gift amount reflects the sender’s chosen value,
  • the recipient has already received the funds into their account with the payment provider.

SwayGifts does not reverse gifts based on dissatisfaction with message content or personal outcomes.

6. Gifting to a Recipient Not Yet Verified

When a sender chooses to attach a gift to a recipient who has not yet joined SwayGifts:

  • no payment is taken at the time the message is sent,
  • no refund is necessary at this stage.

If the recipient does not complete setup within 30 days:

  • the recorded gift intent expires automatically,
  • the sender is notified and may choose to resend,
  • no payment occurs and no funds move.

7. Dependent and Child Celebration Pages

For celebration pages created for children or dependents:

  • all payments are settled to the verified parent or guardian’s account with the payment provider,
  • children do not receive funds,
  • no money is saved, locked, deferred, or set aside for the child,
  • refund eligibility follows the same rules as other gifts.

SwayGifts does not manage, hold, or earmark funds for children.

8. How to Request a Refund

If you believe you are eligible for a refund, you may contact SwayGifts support within 30 days of the transaction with:

  • transaction details (including the date and approximate amount),
  • a description of the issue.

SwayGifts will review the request and, where appropriate, coordinate with the payment service provider.

Approved refunds are processed through the payment service provider and returned to the original payment method where possible. Processing times for approved refunds are subject to the payment provider’s standard schedules and are not controlled by SwayGifts.

9. Effect of Refunds and Chargebacks on Messages

Celebration messages are delivered independently of payment. If a refund is approved or a chargeback succeeds:

  • the celebration message may remain visible to the recipient,
  • the message is not automatically deleted,
  • the gift amount status is updated to reflect the reversal.

This is consistent with SwayGifts’ message-first design, where messages exist independently of financial outcomes.

10. Disputes and Chargebacks

If you initiate a dispute or chargeback through your payment provider:

  • the payment provider’s dispute process applies,
  • SwayGifts cooperates fully and provides transaction context, message records, occasion details, and user verification information as needed,
  • final decisions are made by the payment provider in accordance with their rules.

Because each transaction on SwayGifts is a discrete payment from a verified sender to a verified recipient with clear occasion context, the platform maintains a strong evidentiary position to support dispute resolution.

Excessive or abusive disputes or chargebacks may result in account restrictions or suspension.

11. Service Fees

Service fees charged by SwayGifts are generally non-refundable, except:

  • where required by law, or
  • in cases of technical error or incorrect charge.

12. Legal Rights

Nothing in this Policy limits any rights you may have under applicable consumer protection laws, including under the Australian Consumer Law.
