1. About SwayGifts

SwayGifts is a digital gifting experience platform that enables people to celebrate life moments by sending personalised celebration messages, optionally accompanied by a gift amount. SwayGifts values privacy and is committed to handling personal information responsibly and transparently in accordance with the Australian Privacy Act 1988 and applicable international privacy laws.

2. Information We Collect

We collect only the information necessary to operate the platform, provide services, and meet legal and compliance obligations.

2.1 Information You Provide

Depending on how you use SwayGifts, you may provide:

  1. name, email address, and contact details,
  2. account login credentials,
  3. celebration messages and related content (text, photos, video),
  4. recipient contact information provided by senders for gift delivery,
  5. customer support communications.

Parents or guardians may provide limited information about children or dependents for the purpose of creating celebration pages.

2.2 Identity Verification Information

Recipients who wish to receive gift amounts are required to complete identity verification (KYC) through our third-party payment service provider.

The payment provider collects and processes identity verification data directly, which may include:

  1. full legal name and date of birth,
  2. residential address,
  3. government-issued identity document details,
  4. bank account or card details for payout setup.

SwayGifts does not collect or store identity documents, bank account numbers, or full payment card details. We may receive limited verification status information from the payment provider (such as whether verification was successful) for the purpose of managing the gifting experience.

2.3 Payment and Transaction Information

Payment details are collected and processed by our third-party payment service provider. SwayGifts does not store full payment card details or bank account numbers.

We may receive limited payment-related information from the payment provider for record-keeping, support, and compliance purposes, including:

  1. transaction amounts and currency,
  2. transaction status (completed, failed, refunded),
  3. payment provider transaction identifiers,
  4. platform fee amounts,
  5. settlement and payout status.

2.4 Automatically Collected Information

When you use SwayGifts, we may automatically collect:

  1. device and browser information,
  2. IP address,
  3. usage and interaction data,
  4. cookies or similar technologies for basic functionality and analytics.

3. How We Use Information

We use personal information to:

  1. provide and operate the SwayGifts platform,
  2. deliver celebration messages to recipients,
  3. facilitate optional gifting payments through the payment provider,
  4. coordinate identity verification and payout setup with the payment provider,
  5. communicate with users about their activity and account status,
  6. provide customer support,
  7. detect and prevent fraud, abuse, or misuse,
  8. comply with legal and regulatory obligations,
  9. cooperate with payment provider investigations, disputes, and chargebacks.

We do not sell personal information.

3.1 Legal Basis for Processing

We process personal information on the following bases:

  1. Contractual necessity: to provide the services you have requested, including message delivery, payment facilitation, and account management.
  2. Legal obligation: to comply with applicable laws, regulations, and payment provider requirements, including anti-money laundering and fraud prevention obligations.
  3. Legitimate interests: to improve our services, ensure platform security, and detect misuse, where these interests are not overridden by your rights.
  4. Consent: where required by applicable law, such as for certain marketing communications or cookie usage.

4. Recipient Contact Information

When a sender gifts someone who is not yet on SwayGifts, the sender provides recipient contact details (such as email or phone number) to facilitate message delivery.

This information is used to:

  1. deliver the celebration message to the recipient,
  2. notify the recipient of pending gift intent,
  3. invite the recipient to join SwayGifts if they choose to.

If the recipient does not join SwayGifts within 30 days, the gift intent expires. Recipient contact information provided by senders is retained only for as long as necessary to facilitate the gifting experience, after which it is deleted or anonymised.

Recipients who do not join SwayGifts are not added to marketing lists.

5. Children and Dependent Profiles

SwayGifts does not allow children to create independent accounts.

Parents or guardians may create celebration pages for children or dependents. Information related to children is:

  1. provided and controlled by the parent or guardian,
  2. used only to support the celebration experience,
  3. not used for marketing purposes,
  4. subject to heightened data protection safeguards.

Children do not participate in financial activity on the platform. No financial data, identity verification data, or payment information is associated with child or dependent profiles.

6. How We Share Information

We share personal information only when necessary and appropriate.

6.1 Payment Service Provider

We share information with our payment service provider for the purposes of:

  1. processing gift payments,
  2. facilitating recipient identity verification and connected account creation,
  3. managing payouts, refunds, and dispute resolution.

The payment provider processes this information under its own privacy policy and terms. SwayGifts is not responsible for data collected directly by the payment provider during identity verification or payout setup.

6.2 Other Service Providers

We may share information with other trusted service providers, including:

  1. hosting and infrastructure providers,
  2. analytics and security services,
  3. communication and notification services.

These providers are permitted to use information only to perform services on our behalf.

6.3 Legal and Compliance

We may disclose information if required to do so by law, regulation, legal process, or request from authorities.

6.4 Business Transfers

If SwayGifts is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to applicable privacy protections.

7. Data Storage and Security

We take reasonable measures to protect personal information against unauthorised access, loss, misuse, or alteration.

Information is stored using reputable cloud infrastructure and security practices. However, no system is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain personal information only for as long as necessary to:

  1. provide services,
  2. meet legal and compliance requirements,
  3. resolve disputes,
  4. enforce our agreements.

Information may be retained longer where required by law. When personal information is no longer needed, it is deleted or anonymised.

Recipient contact information provided by senders for unverified recipients is deleted or anonymised after the 30-day gift intent expiry period if the recipient does not join.

9. Your Rights and Choices

Depending on your location, you may have rights to:

  1. access personal information we hold about you,
  2. request correction of inaccurate information,
  3. request deletion of your account or data, subject to legal obligations,
  4. request portability of your data in a structured, commonly used format,
  5. object to or restrict certain processing of your information,
  6. withdraw consent where processing is based on consent.

Requests can be made by contacting us using the details in Section 14.

If you are located in the European Economic Area, you also have the right to lodge a complaint with your local data protection supervisory authority. If you are located in Australia, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

10. Cookies and Similar Technologies

SwayGifts uses cookies and similar technologies to:

  1. enable basic site functionality,
  2. understand usage patterns,
  3. improve user experience.

You can manage cookie preferences through your browser settings. Disabling certain cookies may affect platform functionality.

11. International Data Transfers

SwayGifts is based in Australia. Your information may be stored or processed in other countries where our service providers operate, including countries where the payment service provider processes identity verification data and manages connected accounts.

We take reasonable steps to ensure appropriate data protection safeguards are in place for international transfers, including contractual protections with service providers.

The payment service provider may transfer and process your data in jurisdictions outside your country of residence under its own privacy policy and data protection practices.

12. Data Breach Notification

In the event of a data breach that is likely to result in serious harm to affected individuals, SwayGifts will notify affected users and the relevant supervisory authority in accordance with applicable law, including the Notifiable Data Breaches scheme under the Australian Privacy Act 1988.

13. Changes to This Policy

We may update this Privacy Policy from time to time.

If we make material changes, we will update the effective date and notify you by email or through the platform before the changes take effect. Your continued use of SwayGifts after changes take effect constitutes acceptance of the updated Policy.
